New California Workers' Compensation Requirement
California Law SB 228 took effect January 1, 2004. It requires every California
employer, in order to get Workers' Compensation Insurance, to have a written
Injury and Illness Prevention Program (IIPP) that has been certified for
California.
California Insurance Companies, because of the new SB228 legislated requirement,
are adding language to their coverage proposals to address California
Labor Code 6401.7 regarding the IIPP. That labor code provision requires
every Insurance Company to review each employer's written IIPP within
four months of binding Workers' Compensation Insurance.
The new wording Insurance Companies are adding, while varying between
companies, basically requires applicants for insurance to submit their
IIPP when the request to bind coverage is made
if it was not submitted
when the initial request for a coverage proposal was made. In short: you
must have a written IIPP in California in order to get workers' compensation
coverage bound.
Insurance Companies are gearing up to meet this requirement. You will
need to be able to present your IIPP to them.
