The Drivers Privacy Protection Act and How it will Affect You
The Drivers Privacy Protection Act (DPPA), the Fair Credit Reporting
Act (FCRA) and the Gramm-Leach-Biley Act (GLB) all impose restrictions
on the release of consumer privacy information to third parties. Because
of these restrictions, we must modify our procedures for obtaining Motor
Vehicle Reports for your employees or prospective employees.
We are no longer allowed to release information contained in the Motor
Vehicle Report to any third party without the express permission of the
driver. A third party is anyone other than the insurance company requesting
the information.
As part of our service to you, we will continue to order MVR printouts
and continue to forward them to the insurance company as part of your
application for insurance.
In order for us to release the information contained in those reports
(either verbally or in written form) to you, the employer, we must receive
a signed authorization form from the driver.
Attached are samples of these forms. We suggest that you incorporate these
forms in your Employee Handbook and have them completed, dated and signed
at the time of hire or during the pre-hire process. This will allow you
to obtain this important information without undue delay. We have also
included a form that can be completed "on the fly" when you
have an urgent need for driver information.
